Present criminal appeal has been filed against the judgment and order dated 29.11.1983 passed by Vth Additional Sessions Judge, Bareilly in Sessions Trial No. 511 of 1982 (State Versus Triveni Lal), under Section 376/511 I.P.C., Police Station Nawabganj, District Bareilly, by which learned trial court has convicted the appellant under Sections 376/511 I.P.C. and directing him to be released on probation of good conduct and good behaviour for a period of two years. 3. Learned counsel for the appellant argued that the appellant is innocent and have committed no offence. He further submitted that time for which the appellant was released on probation, has already expired, therefore, this appeal has become infrcutuous. 4.Learned A.G.A. has no objection in this regard. 5. Since period for which the appellant was released on probation of good conduct and good behaviour for a period of two years, has already been passed and appellant is not willing to go into the merit of the case, therefore, this appeal is liable to be dismissed as being infructuous. 6.
