19.12.2025 CRL.M.A. 37076/2025 (modification of order dated 02nd December, 2025)
1. The above-captioned bail application was allowed by order dated 2nd December, 2025. By way of the present application, the Applicant seeks modification of the bail condition contained in Paragraph No. 10(c) of the said order. It is submitted that the Applicant is a permanent resident of Mumbai and, therefore, the condition restricting her movement beyond the National Capital Territory of Delhi be deleted. The Applicant, however, undertakes to appear before the concerned SHO and the Trial Court as
directed. 2. It is further pointed out that the bail order inadvertently records that This is a digitally signed order. the chargesheet has been filed in the FIR, whereas the investigation is still ongoing. On this aspect, this Court had sought clarification from the State regarding the stage of investigation. It emerges that the investigation is continuing and the chargesheet has not yet been filed. Mr. Amit Ahlawat, APP for the State, submits that the reference to the filing of the chargesheet in the order dated 2nd December, 2025 was possibly on account of an inadvertent submission advanced at the time of hearing. He further clarifies that the status report does not reflect that the chargesheet has been filed. 3. It is also brought to the notice of the Court that on 1st December, 2025, the Trial Court had granted bail to the co-accused, Manish Singh, who is alleged to be the receiver of the contraband. This fact could not be brought to the notice of this Court at the time of passing of the bail order, as the IO was not aware of the same. 4. Be that as it may, the aforesaid aspects, though relevant, do not constitute material circumstances, which would have altered the outcome of the bail application, particularly in view of the reasons already recorded in the order dated 2nd December, 2025. 5. In light of the forgoing, the application is disposed of with the following directions:
5.1. The condition contained in Paragraph No. 10(c) of order dated 2nd December, 2025 stands deleted. All other conditions noted in the order remain intact. 5.2. Paragraph No. 3.4 of the order shall be read as “All recoveries stand effected; therefore, the continued custodial detention of the Applicant is not required.”
5.3. Paragraph No. 9 of the order shall be read as “The Court also cannot This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

ignore that the Applicant is an 18-year-old college student with no prior criminal antecedents and is not alleged to be a habitual offender. The substantive recoveries have been effected from the co-accused, and there is no assertion that her further custodial interrogation is required. In these circumstances, her continued incarceration would serve little purpose so far as investigation is concerned and would tend towards pre-trial punishment. The Supreme Court has held that the object of granting bail is neither punitive nor preventative. The primary aim sought to be achieved by bail is to secure the attendance of the accused person at the trial.”
6. With the above directions, the application is disposed of. SANJEEV NARULA, J DECEMBER 19, 2025/ab This is a digitally signed order.
