TAHSILDAR, BHAMINI MANDAL, SRIKAKULAM DISTRICT. ...RESPONDENT(S): 2 HBKM,J W.P.No.9628 of 2020 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a Writ, order or direction more particularly in the nature of WRIT OF MANDAMUS declaring the action of the respondents in insisting me to vacate from my agricultural lands admeasuring Ac.2.45 cents in Survey No.345/1 and Ac.1.39 cents in Survey No.345/2 situated in Bhamini Village of Bhamini Mandal in Srikakulam District and consequential action of the respondents highhandedly forming road for 'Government Ekalavya Gurukula Paatashala' through my above said lands without initiating the proceedings under the provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 as illegal, irregular, irrational, without any authority of law, violative of provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed there under and offends Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to interfere with my peaceful possession and enjoyment of above said lands and also not to form any road through my said lands without following due process of law and to pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents not to form road for 'Government Ekalavya Gurukula Paatashala' through my agricultural lands admeasuring Ac.2.45 cents in Survey No.345/1 and Ac.1.39 cents in Survey No.345/2 situated in Bhamini Village of Bhamini Mandal in Srikakulam District and consequently direct the respondents not to interfere with my peaceful possession and enjoyment of my said lands, without following due procedure established by law pending disposal of the above writ petition and to pass Counsel for the Petitioner: 1. This writ petition was filed questioning the action of the respondents in insisting the petitioner to vacate from the agricultural lands admeasuring Ac.2.45 cents in Survey No.345/1 and Ac.1.39 cents in Survey No.345/2 situated in Bhamini Village of Bhamini Mandal in Srikakulam District and consequential action of the respondents highhandedly forming road for 'Government Ekalavya Gurukula Paatashala' through the above said lands without initiating the proceedings under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. 3. The learned Assistant Government Pleader relying upon the written instructions of the 6th respondent dated 26.10.2025 submits that the proposal to lay road was dropped and the Government Ekalavya Gurukula Paatashala was constructed at another place situated in Bhamini Village and Mandal. The said Government Ekalavya Gurukula Paatashala, Bhamini was constructed and it is functioning in the said place. 4. In view of the above said facts and circumstances and upon instructions of the 6th respondent dated 26.10.2025, no cause survives in this writ petition. 4 HBKM,J W.P.No.9628 of 2020 5. Accordingly, this Writ Petition is dismissed as infructuous. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 6th respondent dated 26.10.2025 shall be made as part of the Court record.
