2 MANDAMUS for the inaction of the Respondents in releasing the Maintenance Grant at the rate of 6percentage to the Petitioner institution for the academic years 2022-2023, 2023-2024, and 2024-2025, amounting to a sum of Rs. 3,87,154/-. as mandated under Section 3 of the Andhra Pradesh Educational Institutions (Maintenance Grant) Regulation Act, 1995, and as per the law laid down by this Hon’ble Court in 1997 (3) ALD 40 and in the
order passed in W.P. No. 3449 of 2003, dated 30.09.2016. as arbitrary, illegal, and in violation of Article 30(1) and Article 21A of the Constitution of India, 1950 and consequently direct the Respondents to forthwith release and pay the Maintenance Grant at the rate of 6percentage for the aforementioned academic years to the Petitioner institution. 3 The Court made the following ORDER: This Writ Petition is filed, under Article 226 of the Constitution of India, questioning the action of the respondents in not releasing the Maintenance Grant at the rate of 6% to the petitioner institution for the academic years 2022-2023, 2023- 2024 and 2024-25, amounting to Rs.3,87,154/-, as mandated under Section 3 of the AP Educational Institutions (Maintenance Grant) Regulation Act, 1995.
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for School Education for the respondents.

Learned counsel for the petitioner submitted that the respondents-authorities are not releasing the arrears of maintenance grant at the rate of 6% on the teaching grant payable to the petitioner school. He also submitted that the issue in this Writ Petition is squarely covered by the orders passed by this Court in WP No.3449 of 2003, dated 30.09.2016, and prayed to pass similar order in this matter. Learned Assistant Government Pleader conceded the said submission.
4. Accordingly, placing the submission on record and in view of the reasons stated in the said order, this Writ Petition is allowed in terms of the above said order. No order as to costs.
5. Registry to attach a copy of the order, dated 30.09.2016, in W.P.No.3449 of 2003 along with this order.

4 As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
