Learned counsel for the appellants submits that I.A.No.1 of 2018 in the present appeal, seeking suspension of the aforesaid order, dated 20.12.2017, was dismissed for non-prosecution on 22.11.2018, so also, the suit in O.S.No.70 of 2017 on the file of the X Additional District Judge, Tirupati, itself has been dismissed for default on 16.08.2023, and consequently this appeal has been rendered infructuous. 3. Recording the same, the Civil Miscellaneous Appeal is dismissed as infructuous. 4. No order as to costs. 5.
