case bearing No. 169 of 2012 in a FIR No. 521 dated 19.10.2008 registered under Section 419, 420, 467, 468 and 471 of the Indian Penal Code, 1860 at Police Station Civil Line, Karnal as well as the dismissal of the appeal vide

2.
At the very outset, Counsel for the petitioner contends that he does not intend to raise any challenge to the conviction on merits and would confine his prayer only to the quantum of sentence. It is contended that co- accused of the petitioner had also filed CRR-643 of 2015 and that vide order dated 19.10.2024, the said identically placed co-accused has already been released on probation. He contends that he, thus, confines his prayer for being released on probation as the facts and circumstances of the case are identical and the petitioner has already undergone an actual sentence and custody was also at par. The petitioner is not involved in any other criminal offence even during the interregnum period.
3.
Counsel for the respondent-State does not dispute the same and has no objection to the grant of probation. The present petition is accordingly disposed of in terms of the order dated 19.10.2024, for the reasons set out thereunder, upholding the conviction. The petitioner is however directed to be released on probation on his furnishing probation bond in the sum of Rs. 20,000/- with a surety of like amount and on further furnishing an undertaking of keeping peace and good behaviour of two years to the satisfaction of the Judicial Magistrate. The petitioner shall also remain under the supervision of the concerned probation officer during the aforesaid period. In the event of the petitioner failing to comply with the said direction or committing breach of the undertaking given by him, he shall be called VISHAL SHARMA 2025.09.02 18:52 I attest to the accuracy and integrity of this document
