PUBLIC PROSECUTOR The Court made the following: 2 COMMON ORDER: The Criminal Petition No.10339 of 2025 has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.18 for granting of pre-arrest bail in connection with Crime No.115 of 2025 of Satyanarayanapuram Police Station, Vijayawada, NTR District, registered for the alleged offence punishable under Sections 318(4) and 316(2) of Bharatiya Nyaya Sanhita (for short ‘the BNS). 2. The Criminal Petition No.10341 of 2025 has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.18 for granting of pre-arrest bail in connection with Crime No.114 of 2025 of Satyanarayanapuram Police Station, Vijayawada, NTR District, registered for the alleged offence punishable under Sections 318(4) and 316(2) of Bharatiya Nyaya Sanhita (for short ‘the BNS). 3. Even though these two Criminal Petition Nos.10339 and 10341 of 2025 arise out of two different crimes namely crime Nos.115 of 2025 and 114 of 2025 respectively of Satyanarayanapuram Police Station, NTR Commissiionerate, the nature of the transactions in both the crimes is one and the same. The petitioners are also same in the two FIRs. Hence, these two criminal petitions are heard together and disposed of by way of this common order. 3 4. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. 5. This Court in Crl.P.Nos.8787 and 8789 of 2025 on 12.09.2025 granted pre-arrest bail to accused Nos.3, 17, 19 and 20. The accused No.1 was already enlarged on regular bail by the trial Court. The learned Assistant Public Prosecutor submits that the petitioner was the beneficiary of an amount of Rs.2,64,00,000/- (Rupees Two Crores and Sixty-Four Lakhs only) during the period from 10.01.2020 to 20.03.2021. The petitioner is a female, aged about 26 years. It is admitted by the learned Assistant Public Prosecutor that the said amounts were deposited into the petitioner’s bank account while she was residing in the USA. The learned Senior Counsel submits that the petitioner's bank account was being managed by accused No.1, and that the petitioner was made to flee by him. It is further submitted that the petitioner herself is a victim at the hands of her father/accused No.3. The learned Senior Counsel also submits that the petitioner is presently residing in the USA, where she is married, employed, and was blessed with children at the time of the alleged offence. At no point during the relevant period did she visit India. 6. Considering the gravity and nature of the allegations leveled against the petitioner/accused No.18 in Crl.P.No.10339 of 2025 and the petitioner/accused No.18 in Crime No.10341 of 2025, this Court is inclined to grant pre-arrest bail to the petitioner/accused No.18 in Crl.P.No.10339 of 2025 and the petitioner/accused No.18 in Crime No.10341 of 2025. 4 7. In the result, the Criminal Petition Nos.10339 and 10341 of 2025 are allowed with the following conditions: i. In the event of arrest of the petitioner/accused No.18 in Crl.P.No.10339 of 2025 and the petitioner/accused No.18 in Crime No.10341 of 2025, she shall be enlarged on bail subject to she executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each in Crl.P.No.10339 of 2025 and Crl.P.No.10341 of 2025 with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The petitioner/accused No.18 in Crl.P.No.10339 of 2025 and the petitioner/accused No.18 in Crime No.10341 of 2025 shall make herself available for investigation as and when required; iii. The petitioner/accused No.18 in Crl.P.No.10339 of 2025 and the petitioner/accused No.18 in Crime No.10341 of 2025 shall not cause any threat, inducement or promise to the prosecution witnesses; ________________________ Dr.Y.
