[2025:RJ-JP:11963-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Special Appeal Writ No. 408/2022 In S.B. Civil Review Petition No.33/2021 In S.B. Civil Writ Petition No.21498/2019 Chunni Lal S/o Shri Ram Lal, Aged About 77 Years, R/o 1199/5, Uniyara House, Uniyaron Ka Rasta, Chandpole Bazar, Jaipur. ----Appellant Versus Chairman And Managing Director, Rajasthan State Bridge And Construction Corporation Limited, Setu Bhawan, Jhalana Doongri, Agra Byepass, Jaipur Now Substituted And Changed Name Rajasthan State Road And Development Corporation Limited, Setu Bhawan, Jhalana Doongri, Agra Bypass, Jaipur. ----Respondent For Appellant(s) : Mr. Ankul Gupta for Mr. Babu Lal Gupta For Respondent(s) : Mr. VP Mathur HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 18/03/2025 1. With the consent of the parties, the matter is heard finally. 2. Brief facts of the case are that the appellant-workman (hereinafter to be referred as workman) worked with the respondent-employer (hereinafter to be referred as employer) for a period of five years. The service of the workman was terminated by the employer in the year 1990. After a delay of twelve years, the workman raised a dispute by filing a claim petition before the learned Labour Court. The learned Labour Court allowed the claim petition and awarded the compensation of Rs.1 lakh, which was challenged by the employer before this Court. Dissatisfied with the award passed by the learned Labour Court, the workman also filed SBCWP No.21498/2019 before this Court and this Court dismissed the said writ petition by observing that Rs.1 lakh as [2025:RJ-JP:11963-DB] (2 of 2) [SAW-408/2022] compensation awarded by the learned Labour Court is just and reasonable. 3. Learned counsel for the workman submitted that the workman has worked for a period of five years with the employer and prayed for enhancement of the compensation. 4. Learned counsel appearing on behalf of the employer opposed the submissions made by the counsel for the workman and submitted that the order passed by the learned Single Judge is just and reasonable. 5. We have heard counsel for the parties and perused the record. 6. In our considered view, the workman has worked with the employer for a period of five years. In such circumstances, the compensation awarded by the learned Labour Court is not proper. We have also considered the fact that the workman raised the dispute after a delay of twelve years, therefore considering the facts and circumstances of the present case, we direct that the compensation awarded by the Labour Court is further enhanced from Rs.1 lakh to Rs.2 lakh as full and final settlement between the parties. 7. In that view of the matter, the award dated 22.11.2019 stands modified and, accordingly, the employer is directed to pay Rs.1 lakh as an additional compensation to the workman within a period of 60 days. 8. The appeal stands disposed of accordingly. (PRAMIL KUMAR MATHUR),J (INDERJEET SINGH),J Sunita/45
