W.P.(C)No.11909 of 2025 :2: 2025:KER:25159 2 DIRECTOR OF GENERAL EDUCATION OFFICE OF THE DIRECTOR OF GENERAL EDUCATION, JAGATHI, THIRUVANANTHAPURAM, PIN – 695014. 3 DISTRICT EDUCATIONAL OFFICER OFFICE OF THE DISTRICT EDUCATIONAL OFFICER, PALLISSERY, THALASSERY, PIN – 670104. 4 ASSISTANT EDUCATIONAL OFFICER OFFICE OF THE ASSISTANT EDUCATIONAL OFFICER, PANOOR, KANNUR, PIN – 670692. BY ADV.SMT. ANIMA M., GOVERNMENT PLEADER THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 24.03.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
W.P.(C)No.11909 of 2025 :3: 2025:KER:25159 J U D G M E N T Dated this the 24th day of March, 2025 The grievance of the petitioner is that though she was appointed as LPST with effect from 16.07.2021, her appointment was not approved by stating that the petitioner did not pass K-TET examination. Now, the petitioner has passed K-TET examination as evidence by Ext.P4. The 1st respondent- Government issued an order granting time to pass K-TET examination and declared that the Government will be conducting an examination during May, 2025. 2. In the same order, it is stated that the applicants who have passed K-TET examination after August, 2023 are also eligible to get approval of their appointment as the eligible qualification under Rule 3 of Chapter XIVA of KER. W.P.(C)No.11909 of 2025 :4: 2025:KER:25159 In the light of Ext.P6 order, the petitioner is entitled to get her service approved with effect from 16.07.2021. 3. Pointing out the above facts, the petitioner submitted Ext.P7, stating that the only objection raised has been rectified and there is no impediment in approving the appointment of the petitioner with effect from 16.07.2021 and that petition is pending. The petitioner is working without any salary with effect from 16.07.2021, contends the petitioner. 4. Heard. 5.
The approval for the appointment of the petitioner was earlier declined in view of the fact that the petitioner is not holding the K-TET qualification. The petitioner submits that the petitioner has now acquired the K-TET qualification. In that view of the matter, it would be only just and proper that the Assistant Educational Officer consider Ext.P7 representation submitted by the petitioner in the light of Ext.P4
W.P.(C)No.11909 of 2025 :5: 2025:KER:25159 Certificate and Ext.P6 Government Order. The writ petition is therefore disposed of directing the 4th respondent-Assistant Educational Officer to consider Ext.P7 representation submitted by the petitioner in the light of Exts.P4 and P6, and pass appropriate orders thereon within a period of one month.
