GP FOR HOME (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 344 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No. 3 and 4 herein in calling the petitioner to the police station more particularly to the office of the 4th respondent for payment of loan amount due by the 5th respondent to the financial institution i.e., City Union Bank as illegal, arbitrary and also oppose to Article 21 of the Constitution of India as well as abuse of power of police consequentially direct the respondents 3 and 4 herein not to interfere with civil disputes by directing not to call the petitioner to the office forthwith.…” 2. None represented for the petitioner. 3. When the matter is taken up for hearing, Sri V.Farook, learned Assistant Government Pleader for Home, on instructions, would submit that basing on the complaint of the 5th respondent, the petitioner was called to the police station for preliminary enquiry. But the petitioner did not turn up for the same. After examining the contents of the complaint, the police have advised the 5th respondent to approach the competent civil court, as the matter is relating to civil disputes. He would further submit that the police never interfered in the civil dispute between the parties. 4. Recording the same, this Writ Petition is disposed of.
