It is submitted by the learned counsel for petitioners that the incident took place on 30.03.2025 and complaint came to be filed on 01.04.2025. There is two days’ delay in filing the complaint. On the date of alleged incident, one Tonikumar Bandi has sustained injuries. In this regard, he was admitted to Shakuntala Memorial Hospital and Research Centre with a history of assault. MLC also done but the concerned police have not taken any action in this regard. The injured Harish Kumar has - 4 - NC: 2025:KHC-D:7174 CRL.P No. 101793 of 2025 taken initial treatment at KIMS Hospital and admitted as inpatient at Vivekanand Hospital, Hubballi due to fracture of leg bone. The injured have not received any injury on the vital part of the body and accused are not required for further investigation. Since the date of arrest, accused are in judicial custody i.e., from 02.04.2025. 6. Taking into consideration the nature and gravity of the offences, injuries caused to the injured, previous antecedents of the petitioners, the period of detention of the accused and delay in filing the complaint, at this stage, it is just and proper to release the petitioners on bail. 7. Hence, I proceed to pass the following: ORDER The Criminal Petition filed by the petitioners/accused Nos.1 and 2 under Section Sections 483 of BNSS is hereby allowed. The petitioners/accused Nos.1 and 2 shall be released on bail in Crime No.50/2025 of Keshwapur Police Station, Hubballi subject to following conditions: - 5 - NC: 2025:KHC-D:7174 CRL.P No. 101793 of 2025 i) Petitioners/accused Nos.1 and 2 shall execute a personal bond for a sum of Rs.1,00,000/- each for the likesum to the satisfaction of the jurisdictional Magistrate. ii) Petitioners/accused Nos.1 and 2 shall make themselves available for interrogation by police officer as and when required. iii) Petitioners/accused Nos.1 and 2 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the court or to any police officer. iv) Petitioners/accused Nos.1 and 2 shall not tamper the prosecution witnesses in any manner.
