The Court made the following order:
This civil revision petition is filed under Article 227 of the Constitution of India by the plaintiff in O.S.No.31 of 2019 on the file of the Court of Junior Civil Judge, Gooty aggrieved by non-disposal of the suit, still keeping it pending for framing issues for a long time. 2. This Court has called for the remarks of the presiding officer of the Court concerned.
The remarks were submitted vide letter dated 26.11.2025 stating that the suit is filed for eviction and for arrears of rent; that the written statement was filed by the defendant on 12.06.2019 and thereafter the suit had been adjourned to 19.06.2019 for filing draft issues as there was no settlement of terms under Section 89 C.P.C., and thereafter, case had been adjourned from time to time by the predecessor officer in the Court during period of COVID; that the issues had not been framed even thereafter; that the present presiding officer of the said Court had taken charge on 29.08.2024, but, had undertaken training from (i) 09.09.2024 to 29.12.2024 as I term and mediation training from 06.01.2025 to 10.01.2025; (ii) 05.04.2025 to 03.05.2025 as II term and ; (iii) 23.06.2025 to 11.10.2025 as III term; and thereafter she had assumed charge on 12.10.2025 and could not frame the issues due to huge pendency of 2115 cases on civil side and 2201 cases on criminal side and that the issues would be framed on the next date of adjournment i.e., on 26.12.2025. 3. As can be seen from the status of the case in the e-Courts, it is shown that the suit was adjourned to 27.02.2026 as the presiding officer was on optional holiday. 4. Though notice has been served on the respondent, no appearance has been made. 3

Under these circumstances, the revision petition is disposed of directing the trial Court to frame issues before 23.01.2026, if necessary by advancing the suit from 27.02.2026 to any earlier date, by giving notice to counsels for both parties. There shall be no orders as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this civil revision petition shall stand closed. ___________________ ___ JUSTICE B.S. BHANUMATHI
