The Court made the following:
ORDER:
This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioner for the following relief:
“ .. to issue a writ of direction more particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in not registering the FIR in pursuance of the complaint of the petitioner dated 25.01.2024 is illegal, arbitrary, unconstitutional and consequently direct the respondents authorities to register the FIR against the respondents 5 ,6 and 7 and their henchmen and to pass ...”
Heard learned counsel for the Petitioner and Learned Assistant Government Pleader for Home representing for respondent State. Perused the material on record.
Learned Assistant Government Pleader placed on record, the written instructions and would submit that petitioner is a quarry company situated at Narsingapalem village, Agiripalli Mandal, Krishna District. The allegation is that the unofficial respondents illegally entered into the petitioner’s quarry lease and doing illegal quarry business. Further, after receipt of the complaint from the Petitioner, Police enquired into the matter, and the revenue officials informed that the excavated gravel were used for filling of house sites and levelling purpose of Jagananna colonies in Narasingapalem village previously, and now there is no excavations done at petitioner’s leased area by the unofficial respondents. Petitioner is intentionally trying to insert the names of the unofficial respondents in the complaint, which is not tenable and requested to dispose of the Writ Petition by passing appropriate orders.

Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of.
In that view, this Writ Petition is disposed of. Petitioner is at liberty to work out the remedy before appropriate forum according to law. No order as to costs. Pending applications, if any, shall stand closed.
