The Station House office, , MVP Police Station Visakhapatnam City, ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the Respondents No. 3 to 6, in opening and continuing the Rowdy Sheet vide No- 6, dt. 03.12.2017, against the petitioner, even there are no cases are pending which is illegal, unlawful and against the principles of natural justice and violation of Articles 14, 19 and 21 of Constitution of India and consequently to direct the respondent no.2 and 3 to remove Rowdy sheet against the petitioner and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents no. 3 to 6, not to call the petitioner to police station and to take any pictures of the petitioner’s family members; till pending disposal of this writ petition and pass Counsel for the Petitioner: BHAGATHI JOGA RAO Counsel for the Respondents: GP FOR HOME The Court made the following order: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 18759 OF 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the Respondents No. 3 to 6, in opening and continuing the Rowdy Sheet vide No- 6, dt. 03.12.2017, against the petitioner, even there are no cases are pending which is illegal, unlawful and against the principles of natural justice and violation of Articles 14, 19 and 21 of Constitution of India and consequently to direct the respondent no.2 and 3 to remove Rowdy sheet against the petitioner and pass.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, by way of counter affidavit, would submit that the cases registered against the Petitioner were ended in acquittal. It is further stated that, to curb and curtail the unlawful activities of the Petitioner in the vicinity, rowdy sheet was opened against the Petitioner. 3. Sri Bhagathi Joga Rao, learned counsel for the Petitioner would submit that, no cases are pending against the petitioner. 4. Considering the submissions made, the Writ Petition is allowed and the impugned Rowdy Sheet vide No.6 dated 03.12.2017, against the Petitioner is hereby set aside. There shall be no order as to costs.
