This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest in connection with Complaint Case No.658 of 2021, for offences under Sections 406 and 420 IPC. The case is pending before the Court of learned Judicial Magistrate, Ranchi.

Learned A.P.P. representing the State opposes the prayer for anticipatory bail.

This case arises out of a complaint case. The Court has already taken cognizance and merely a summon has been issued.

Since this case arises out of a complaint case and cognizance has already been taken, there is no question of custodial interrogation. The only fact which the Court has to be assured of is whether the accused will face the trial or not or whether there is any chance of tampering with the evidence.

The impugned order does not suggest any of the

aforesaid situation. The petitioners are directed to surrender and appear before the Court below and the learned Court below shall consider that there is no necessity to take the petitioners in custody, as there is no question of any investigation, since cognizance has already been taken in this case.

With the aforesaid direction, this Anticipatory Bail Application stands disposed of.
