The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.4 for granting of pre-arrest bail in connection with Crime No.335 of 2025 of Proddatur Rural Police Station, YSR (Kadapa) District, registered for the alleged offence punishable under Sections 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2
2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. This Court in Crl.P.No.8940 of 2025 on 10.09.2025 granted pre-arrest bail to the accused No.2. The learned Single Judge of this Court in Crl.P.No.8435 of 2025 on 16.09.2025 granted pre-arrest bail to accused No.1. Another learned Single Judge of this Court in Crl.P.No.10295 of 2025 on 03.10.2025 granted pre-arrest bail to accused No.3 and in Crl.P.No.10323 of 2025 on 03.10.2025 granted pre-arrest bail to accused Nos.5 and 6. The allegation against the petitioner/accused No.4 is that he along with other accused abetted the deceased (Pedda Obula Reddy) to commit suicide. There are monitory disputes between the petitioner and deceased. Deceased had not cleared the alleged debts to the petitioner and some other accused. The petitioner on one instance demanded the deceased to repay the debt. The deceased could not pay the debt because of his ill health, but the assured all the accused to pay all the debts. However, the petitioner and other accused insisted for payments. Unable to bear the demands, harassment and humiliation caused by the petitioner and other accused he took an extreme step of ending his life by consuming pesticides. The main allegation against the petitioner that he went to deceased for repayment of the loan indebted to him. On a perusal of the averments of the FIR, it comes to notice that because of the words spoken by the other accused, deceased took an extreme step.

There is a suicide note written by the deceased figuring several persons 18 in number, wherein in petitioner is also one among them. 4. Wife of the deceased lodged a complaint against the petitioner and other accused that they perpetrated her husband to commit suicide. As seen from the averments of the FIR, the petitioner/accused No.4 had not met the deceased at the relevant point of time. There are no CDRs in between the petitioner and the deceased. The petitioner is permanent resident of Proddatur, YSR Kadapa District, he is an agriculturist. He has got fixed abode. 5. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.4. 6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.4, he shall be enlarged on bail subject to he executing a self-bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.4 shall make himself available for investigation as and when required; iii. The Petitioner/Accused No.4 shall not cause any threat, inducement or promise to the prosecution witnesses;

iv. The Petitioner/Accused No.4 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.4 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused No.4 shall surrender his passport, if any, to the investigating officer. If he claim that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer.
