GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 6th respondent in not registering the crime on the complaint given by the petitioners manager on 17.11.2021 pertaining. to the theft of Rs10.09.670/- from his company and registering a counter case against the petitioner in collusion with the thief 2 vide Crime No.322 of 2021 Dt.24.11.21 u/s.323, 342, 384, 506 of IPC and sending the petitioner for remand in Cr.No.232/2021 U/s.323. 324, 384, 506 r/w 34 without following guidelines issued in Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273 at para.No.11 to 13 is illegal, arbitrary and unconstitutional and violation Article 14. 19 and 21 of the Constitutions of India and violation of directions issued by Hon'ble Apex court in Arnesh Kumar vs State of Bihar, (2014) 8 SCC 273 Consequently direct the 2nd and 3rd respondent a. To conduct enquiry and trice departmental action against 6th respondent and b. Transfer the crime No 322 of 2021 Dt.24.11.2021 u/s.323. 34. 342. 384.506 of IPC to an independent officer who is not subordinate to the 6th respondent and c. Install CCTVs in Town and Rural Police Stations of Ponnuru.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on instructions, would submit that a case in Crime No.232 of 2021 on the file of Ponnuru Town Police Station has been registered against the Petitioner and others and as a counter blast to the said case, a case in Crime No.322 of 2021 has been registered based on the complaint given by the Petitioner. Both are case and counter cases lodged against each other. 3. Sri Thandava Yogesh, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed to conclude the investigation in both the crimes, if not concluded, and file the report in accordance with law, within a period of two months from the date of receipt of copy of this order. There shall be no order as to costs.
