The prayer sought in the present Writ Petition is as under: “It is therefore prayed that the Hon’ble Court may be pleased to issue Writ of Prohibition prohibiting the Hon’ble Sr. Civil Judge, Avanigadda, Krishna District from proceeding further in O.S.No.73/2010 pending before him and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.” (The prayer amended as per the Order dated 12.11.2010 passed in W.P.M.P. No.35609 of 2010) 3. On perusal of the docket of this Court would indicate that this Court has not granted any interim order. Since the above prayer would indicate that there is a suit bearing O.S.No.73 of 2010 pending between parties before the Civil Judge (Senior Division), Avanigadda, Krishna District, the said Ld. Civil Judge (Senior Division) would have proceeded with the suit due to absence of any stay of the suit proceedings. 4. In this view of the matter, this Court is of the opinion that this Writ Petition has become infructuous due to the very fact that more than 15 years have passed by and this Court has not shown any indulgence in the cause that is projected so far. 3 5. Accordingly, this Writ Petition is disposed of as having become infructuous. No order as to costs. 6.
