1. Heard Mr. Alok Kumar Dewangan, learned counsel for the petitioner as well as Ms. Akanksha Verma, learned Panel Lawyer for the State/respondent/s.

Learned counsel for the petitioner submits that vide order dated 03.01.2025 he has been posted from the office of Collector, Land Records, District Bastar at Jagdalpur to Revenue Circle, Chitrakot as a Revenue Inspector, Tehsil Lohandiguda. He joined the new place of posting on 06.01.2025 (Annexure P/3) and he is continuing his services there, however, thereafter vide order dated 16.01.2025 he was again posted to Revenue Circle, Darbha, Tehsil Darbha as such this posting order dated 16.01.2025 is not in accordance with law. It is non-else but colourable exercise of power, exercised by the Collector, District – Bastar at Jagdalpur.
3. On the other hand, learned State counsel submits that the posting
order has been passed as per exigency of services and the petitioner cannot claim that he will not be sent to the new place of posting.
4. Considering the fact that vide order dated 03.01.2025, the
3 petitioner has been posted to Revenue Circle, Chitrakot, Tehsil Lohandiguda and the petitioner has joined the said place on
06.01.2025. I do not find any good ground by which order dated 16.01.2025 was again passed without assigning any genuine reason. As such, impugned order dated 16.01.2025 (Annexure P/1) is hereby quashed.
5. Accordingly, this petition is allowed.
