GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION NO. 28204 of 2025 ORDER: Succinctly, the case of the petitioner is that the respondent authorities are trying to lay the road in the land belongs to the petitioner in Survey No.65/2 in an extent of Ac.1.52 cents in Dasegownuru Village, Kuppam Mandal, Chittoor District, without following the due process of law. As per the revenue records, the petitioner is in possession of the subject land and he got the said land by way of registered gift settlement deed and seeking a direction to the respondents not to interfere with the possession of the petitioner’s property without following the due process of law. 2. The learned Assistant Government Pleader has placed the written instructions in Roc:A/278/2025, dated 14.10.2025 of the 4th respondent/Tahsildar, Kuppam Mandal (part of the record) and the said written instructions indicates that the respondent authorities never tried to expand the existing pathway from 4 feet to 10 feet and at present the existing pathway is 4 feet only shown on ground as per Survey and Boundaries Act 1923, which is clearly established in F.M.B sketch of Dasegowniyuru Village of Kuppam Mandal and the allegation made by the petitioner is baseless. 3. In view of the above said circumstances, this Court deems it appropriate to dispose of this writ petition directing the respondents, if 4 at all, they required the land for any public purpose, the respondents shall follow the due process of law. 4. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
