This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.13 15:06:53 +0530 2 applicants, who are apprehending their arrest in connection with Crime No.03/2025 registered at Police Station – Shyang, District Korba (C.G.) for the offences punishable under Sections 120-B, 409, 420, 34 of I.P.C. 2. Case of the prosecution, in brief, is that FIR was lodged on 27/01/25 by the complainant Devanand Shriwas alleging that the accused person whose name in the F.I.R. has defrauded the account holders of the Pradhanmantri Awas Yojna in gram Shyang District Korba. The alleged incident took place in the year 2018-19 but the FIR was registered in the year 2025 against the accused person. 3. Learned counsel for the applicants submits that the applicants are innocent and they have been falsely implicated in this case. He would submit that the applicants are posted as coordinator from 2017 to 2021 at village Shyang District Korba (C.G.) and their duty was to collect data & photographs of beneficiary homes based on the list received from the District Office and in Pradhanmantri Awas Yojna, the amount is deposited directly in the beneficiary account, in which there is no question of any kind of corruption or irregularity and it is completely wrong to say that Pradhanmantri Awas Yojna is incomplete and entire amount has been withdrawn by the applicants. He would submit that the approved house has been fully constructed, no irregularity has been committed by the applicants in the present crime. He would 3 further submit that co-accused person namely Lambodar Kaushik has been granted anticipatory bail by this Court on 11/11/2025 vide MCRCA No.1745/2025, therefore, he submits that the present applicants are also entitled to be released on anticipatory bail. 4. Learned State counsel, appearing for the non -applicant/State do not dispute the fact that co-accused person namely Lambodar Kaushik has been granted anticipatory bail by this Court on 11/11/2025 vide MCRCA No.1745/2025. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, material available on record, considering the fact that co-accused person namely Lambodar Kaushik has been granted anticipatory bail by this Court on 11/11/2025 vide MCRCA No.1745/2025 and also considering the fact that investigation and trial are likely to take some time, therefore, I am inclined to grant anticipatory bail to the present applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Narendra Kumar Sahu & Kaleshwar Prasad Chouhan, on each of them executing a personal bond and one surety in the like sum to the satisfaction of 4 the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
