DR.NO.14-91, RAMALAYAM STREET, GOLLAPROLU, GOLLAPROLU MANDAL, EAST GODAVARI DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ or order more particularly one in the nature of Writ of Mandamus or any other appropriate writ declaring the action of the official respondent No.6 in interfering in civil disputes and insisting the petitioners to frequently call the police station without following the due process of law, and insisting the petitioners to settle the matter with the respondents No. 7 to 10 and further threatening the petitioners with dire consequences of implicating in false cases as illegal, arbitrary, unjustified and also in violation of the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India and for a consequential relief of a specific direction to the official respondents not to interfere in civil disputes between the petitioners and the unofficial respondents 7 to 10 and to pass IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the official respondents not to interfere in civil disputes between the petitioners and the unofficial respondents 7 to 10 and further not to summon the petitioners to the 5th and 6th respondents police station, pending disposal of the writ petition and in the interest of justice. GP FOR HOME (AP) 3 The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioners seeking the following relief: “... to issue a Writ or order more particularly one in the nature of Writ of Mandamus or any other appropriate writ declaring the action of the official respondent No.6 in interfering in civil disputes and insisting the petitioners to frequently call the police station without following the due process of law, and insisting the petitioners to settle the matter with the respondents 7 to 10 and further threatening the petitioners with dire consequences of implicating in false cases as illegal, arbitrary, unjustified and also in violation of the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India and for a consequential relief of a specific direction to the official respondents not to interfere in civil disputes between the petitioners and the unofficial respondents 7 to 10 and to pass ....” None represented for the Petitioners. Learned Assistant Government Pleader for Home on written instructions would submit that there are civil disputes pending between the Petitioners and unofficial respondents, in that connection, civil cases are pending before the competent Civil Court. On the complaint given by respondent No.8 herein that the hay-stack in his field was burnt, a case in Crime No.136 of 2021 of Gollaprolu Police Station is registered and conducted investigation as to how the accident occurred. Except that, respondent Police never interfered in the civil disputes between the parties and never called the Petitioners to the Police Station and would finally submit that this Court may pass appropriate orders by disposing of this Writ Petition.
