This writ petition is filed under Article 226 of the Constitution of India seeking following relief:
“...to issue an order, writ or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not paying the approved bills for an amounts of Rs.19,23,382/- (Rupees nineteen lakhs twenty three thousand three hundred eighty two only) to the petitioner in respect of Agreements vide No.228/2018-19 dated 14.08.2018 in relation to the execution of works - construction of rural Live Stock Unit with Compound Wall at Bayyanagudem Village, Koyyalagudem Mandal, Nidadhavolu Division, Eluru (West Godavari) District, in spite of approval of final bills, as illegal, arbitrary, malafidy, against to the principles of natural justice, contrary to law and in violation of Article 14, 21 and 19(g) of the Constitution of India and consequently direct the respondents to pay the approve bills amounts to the petitioner for the said works to the petitioner forthwith and to pass...”
2. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled to the claim amount, no payment is made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 3. On the other hand, learned Assistant Government Pleader for Agriculture, while admitting about the agreement amount, placed on record instructions received from the respondent No.8, dated
20.09.2025. He further submitted that the subject bill will be uploaded in
3 W.P.No.31032 of 2024 NIDHI portal after allocation of budget at HOD level (i.e., Animal Husbandry Department). 4.
In view of the submissions of the learned counsel for the petitioner and the learned Assistant Government Pleader for Agriculture, this Writ Petition is allowed with a direction to the respondents to release the amount of Rs.19,23,382/- (Rupees nineteen lakhs twenty three thousand three hundred eighty two only) to the petitioner within a period of two (02) months from the date of receipt of copy of this order.
