Heard the parties.
The petitioner has been made accused in connection with Arki P.S. Case No. 61 of 2020, corresponding to G.R. Case No.618 of 2021(S), S.T. Case No.202 of 2022, for the offences registered under Sections 364(A)/34 of the Indian Penal Code and later on, Sections 302/201/120B of the Indian Penal Code and Section 17 of the CLA Act have been added, pending in the court of Sri Rasikesh Kumar, learned Sessions Judge, Khunti.
On 16.06.2020, the driver of the informant was abducted by unknown persons. Later on, his dead body was recovered.
It appears that the statement of two witnesses namely Sukhram Hazam and Jagan Munda have been recorded by the Investigating Officer, they have stated that an unknown person was seen going with Dukan @ Sahu Munda and Hari Singh Munda. Thereafter, the said unknown person was murdered.
Learned A.P.P on behalf of the State has opposed the prayer for bail and after going through the case diary, he has submitted that name of the petitioner has come in the confession of co-accused persons.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Rasikesh Kumar, learned Sessions Judge, Khunti, in connection with Arki P.S. Case No. 61 of 2020, corresponding to G.R. Case No.618 of 2021(S), S.T. Case No.202 of 2022.
