The petitioner is before this Court seeking for the following reliefs: a. Issue a writ in the nature of mandamus or any other appropriate order or direction to the Respondent convert the land of the Petitioner R.S.No. 27/2 measuring 1-00 acre of Rayapur Village of Tq. and dist. Dharwad in to commercial purpose as per Application dated 15-11-2021 vide Annexure-B. b. Issue any other writ, order or direction as deems fit in the cicrcumstances. 2. A memo dated 22.09.2025, signed by the learned counsel for the petitioner has been filed, which reads as under: “In this the Petitioner above named submits as under; That the petitioner has filed this Present Petition seeking nature of Mandamus to direct the Respondent convert the land of the Petitioner R.S. No. 27/2 measuring 1-00 acre of Rayapur village of Tq. and Dist. Dharwad in to commercial purpose as per Application dated 15/11/2021 vide Annexure B. During the pendency of the writ petition the Petitioner had approached the Hubballi Dharwad - 3 - HC-KAR NC: 2025:KHC-D:12817 WP No. 106698 of 2025 Development Authorities for change of land use by making Representation dated 15/09/2025. The Hubballi Dharwad Development Authorities had issued Endorsement dated 20/09/2025 as it is not possible to change the land use. Hence, in view of the same the petitioner intends to withdraw the writ petition and intends to challenge the Endorsement dated 20/09/2025. Therefore the Hon'ble Court dismiss the writ petition as withdrawn with liberty to challenge the Endorsement dated 20/09/2025 in the interest of justice and equity.” 3. Accepting the said memo and submission of the counsel for the petitioner, petition is dismissed as withdrawn, reserving liberty to challenge the endorsement issued. 4. In view of disposal of the writ petition, pending interlocutory applications, if any, do not survive for consideration and are disposed of accordingly.
