No Objection Certificate granted by the Respondent vide orders dated 03-02-2025 as being arbitrary, illegal and violative of Articles 14 and 19 of the Constitution of India and violative of A.P. Educational Institutions (Regulations of Admissions and Prohibition of Capitation Fee) Act 1983 and the Andhra Pradesh Higher Education Monitoring and Regulatory Commission Act and Rules, Regulations framed therein and consequently direct the 1st and 2nd Respondents to determine the fee structure for the Petitioner institution and issue such other writ or order or direction as deemed fit and proper in the circumstances of case. Counsel for the Petitioner: SRI VIJAY MATHUKUMILLI Counsel for the Respondents: GP FOR HIGHER EDUCATION Counsel for the Respondents: VIVEKANANDA VIRUPAKSHA Counsel for the Respondents: CH.S.V.SURAJ SC For JNTU KAKINADA SRK, J WP No.19125 of 2025 3 The Court made the following ORDER: The present Writ Petition has been filed for the following relief. “…..to issue an appropriate Writ more in the nature of Writ of Mandamus declaring the action of 2nd respondent in not determining the fee structure for the block period 2025-26 to 2026-27 for the course “Master of Computer Application (MCA)” being offered by the petitioner institution on the ground that 3rd respondent did not grant affiliation to the petitioner institution, ignoring the fact the petitioner institution got approval from the Apex body, No-Objection Certificate granted by 3rd respondent, vide orders dated 03.02.2025 as being arbitrary, illegal and violative of Articles 14 and 19 of the Constitution of India, AP Educational Institutions (Regulations of Admissions and Prohibition of Capitation Fee) Act, 1983 and the Andhra Pradesh Higher Education Monitoring and Regulatory Commission Act and Rules, Regulations framed therein and consequently direct 1st and 2nd respondents to determine the fee structure for the petitioner institution.” 2. This Court, on 02.09.2025, passed the following interim order. “………….. SRK, J WP No.19125 of 2025 4 Having regard to the facts and circumstances of the case and as the petitioner undertook that they would complete the entire recruitment process according to the norms before 5th September, 2025, respondent Nos.3 and 4 are directed to grant affiliation to the petitioner-College and respondent Nos.1 and 2 are directed to fix minimum fee structure for the course of Master of Computer Application (MCA) within a period of one week from the date of receipt of copy of this order. List the matter after four (4) weeks.” 3. Today, when the matter came up for hearing, learned counsel appearing on behalf of the petitioner institution submits that the respondents have complied with the said interim order, hence no further orders are necessary to be passed in the present Writ Petition. 4. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs.
