1. By the present Writ Petition, the Petitioner who is widow of Late Pradeep Kumar Ukey, who was working on the post of Siksha karmi RAHUL JHA Digitally signed by RAHUL JHA Date: 2025.05.07 17:30:40 +0530
2 Grade-3 at Janpad Panchayat, khairagarh and died in harness on 10/01/2017, is questioning the order dated 28/02/2023 (Annexure-P/7), whereby the application of the petitioner for compassionate appointment has been rejected.

Learned counsel appearing for the petitioner submits that the husband of the petitioner was working as Siksha karmi Grade-3 at Janpad Panchayat, Khairagarh and died in harness on 10/01/2017. He further submitted that the petitioner moved application for the grant of compassionate appointment in light of notification dated 14/06/2013 (Annexure-P/5) issued by the State Govt., but the same has not been considered strictly in accordance with the instructions provided in respect of the compassionate appointment. It is further stated that a committee was constituted by the State Government vide Order dated 13.09.2021 to resolve the dispute with regard to the compassionate appointment of Shiksha Karmis, who died prior to the date of absorption, therefore, the case of the present petitioner may be sent for consideration before the said Committee.
3. On the other hand, learned counsel appearing for the State would oppose the submissions made on behalf of the petitioner and the claim of the petitioner has been rightly rejected by the authorities.
4. Heard learned counsel for the parties and perused the documents placed on the record.
5. It is apparent from the record that the husband of the petitioner died prior to the date of absorption of his services. It is also revealed that a
3 Committee vide Order dated 13.09.2021 has been constituted by the State Govt. to resolve the dispute with regard to the compassionate appointment of Shiksha Karmis, who died prior to the date of absorption,

Considering the above, this writ petition is disposed of with a liberty to the petitioner to move fresh representation before the committee constituted by the General Administration Department on 13.09.2021 raising all the grievances made herein. It is also directed that in the event of the petitioner filing fresh representation before the Committee, the Committee shall consider the representation of the petitioner in accordance with law and decide the same within a period of 60 days from the date of receipt of a copy of this order.
7. With the aforesaid observations and directions, the writ petition is
