MUDUNURI ANAND KUMAR (SC FOR NHAI) The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.32370 of 2025 ORDER: This writ petition is filed seeking the following relief: “….to issue a Writ, Order, or Direction, more particularly in the nature of a Writ of Mandamus by declaring the action of the 2nd respondent in not considering and disposing the representation of the petitioner dated 22.10.2025 for enhancement of compensation payable for the petitioner's lands covered by Survey Nos. 3/1 (admeasuring 4208.88 Sq. Mtrs), 3/2 (admeasuring 5180.16 Sq. Mtrs), 3/6 (admeasuring 7041.78 Sq. Mtrs) and 4/5 (admeasuring 40.47 Sq. Mtrs), situated at Ganginayanapalli Village, Baireddipalli Mandal, Chittoor District, acquired for the purpose of building, widening/four-lanning, maintenance, management, and operation of the Bangalore-Chennai Expressway (National Highway), as illegal, arbitrary, discriminatory, and violative of the principles of natural justice, as well as Articles 14 and 3Q0-A of the Constitution of India Consequently, direct the 2nd respondent to forthwith to consider and dispose of the representation of the petitioner dated 22.10.2025….” 4 2. Heard the learned counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents. 3. According to the averments made in the writ petition, it shows that the subject lands were acquired in the year 2018 and award was also passed and amount was disbursed and received. When that being the situation, after lapse of seven years, the question of entertaining the representation for enhancement of compensation would not arise. Even according to the provisions of the National Highways Act, 1956, if the petitioner has not accepted to the amount of award, she is entitled to file an application for arbitration. 4. In view of the same, there are no merits in the writ petition. 5. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
