Heard Mr. Arvind Kumar Singh, learned counsel for the petitioner and Mr. Om Anand, learned Standing Counsel for the State respondents. 2. The instant petition has been filed for the following reliefs:- "(i) Issue a writ, order or direction in the nature of mandamus direction to the Consolidation Officer Sagri, District Azamgarh (respondent no.2) to decide the restoration application dated 11.2.2025 against the order dated 18.4.1994 in case No. 2048 under Section 9A (2) of U.P.C.H. Act (Rajdeo Vs. Ram Daras) of Village Dewara Kadeem, Pargana, Gopalpur, Tehsil Sagri, District Azamgarh within a fixed period by this Hon'ble Court. (ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents to return the possession to the petitioner." 3. Learned counsel for the petitioner submitted that time barred recall application filed against the order dated 23.8.1993 passed by Consolidation Officer is pending, as such, appropriate direction should be issued for expeditious disposal of pending recall application within time bound period. 4. I have considered the arguments advanced by learned counsel for the parties and perused the records. 5. There is no dispute about the fact that pending recall application is time barred. 6. Considering the facts and circumstances of the case, no case for expeditious disposal of time barred proceeding is made out. 7. The writ petition is dismissed. Order Date :- 5.5.2025 Vandana Y.
