By the present writ petition, the petitioner who is working as Assistant Engineer, Water Resource Department, District Bijapur SOURABH BHILWAR Digitally signed by SOURABH BHILWAR Date: 2025.05.05 18:05:54 +0530 2 / 3 preferred the present writ petition seeking a direction towards the respondent authorities to take necessary decision on the representation dated 19/02/2025 (Annexure P/5) submitted by the petitioner to the Secretary, Water Resource Department. 2. Learned counsel appearing for the petitioner submits that the case of the petitioner is for grant of promotion to the post of Executive Engineer (Civil). The decision of the DPC convened on 28/06/2023 was kept in a sealed cover because of pendency of departmental enquiry and charge sheet against the petitioner. Presently the petitioner has been exonerated from all the charges and for which the Engineer-in-Chief/ respondent No.3 vide communication dated 09/09/2024 has already sent the decision of the DPC which was kept in a sealed cover to the Secretary, Water Resource Department for necessary action regarding the promotion of the petitioner. He further submits that the petitioner has submitted a representation to the Secretary to take necessary steps on the basis of the decision of the DPC convened on 28/06/2023, however, the same has not been decided till date and no decision has been taken on the decision of the DPC. 3. Learned counsel for the respondents/ State submits that necessary steps regarding promotion of the petitioner will be taken pursuance to the decision of the DPC dated 28/06/2023, within the stipulated time. 4. I have heard learned counsel for the parties and perused the documents as well as the pleadings of the petitioner. 3 / 3 5. From perusal of the communication dated 09/09/2024, it appears that the Engineer-in-Chief/ respondent No.3 has already sent the decision of the DPC which was kept in a sealed cover to the Secretary, Water Resource Department for necessary action regarding the promotion of the petitioner. 6. In view of the above and looking to the submission made by the parties, it is directed that the concerned authority respondent No.1/ Secretary, Water Resource Department shall take necessary steps and take appropriate decision on the basis of the recommendation of the DPC as far as the petitioner’s case for promotion is concerned within a period of 50 days from the date of receipt of a copy of this order. 7.
