On 05.10.2017, notices were issued to appellant as well as respondent. Office report dated 07.08.2025 indicates that the notice sent to sole appellant has returned with postal remark " पतत अधधरत अतत वतपस।" As far as notice issued to respondent nos. 1 and 2 is concerned, notice sent to respondent no. 1 has not returned after service so far and notice sent to respondent no. 2 has returned back with postal remark " कतफफ तलतश कक बतद पतत नहह चलत वतपपस। " The report further indicates that Mr. Anjit Kumar, Advocate, and Mr. V.C. Tiwari, Advocate, have put in appearance on behalf of respondent no. 1. In view of said office report, notice upon appellant and respondents is deemed sufficient. As no one has put in appearance on behalf of appellant, the appeal is dismissed for want of prosecution. Interim order, if any, stands vacated. However, if any cause of action survives, appellant may file a recall application.
