GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 2 to 4 respondents in kept quiet without taking any action against the 5th respondent and his men in view of the complaint of the petitioner dated. 16.11.2021and 16.03.2023 as illegal, arbitrary, dereliction of duties and 2 violation of Principles of Natural justice and Art.14 and 21 of Constitution of India and consequently direct the respondents 2 to 4 to register a case against the 5th respondent and his men in view of the complaint given by the petitioner dated.16.11.2021 and 16.03.2023” 2. Heard Ms.Sireesha Rani, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, by way of a counter affidavit, would submit that the police have registered a case against the petitioner herein and others in Crime No.123 of 2021 for the offences punishable under Sections 447, 427 read with 34 IPC. Learned Assistant Government Pleader would further submit that the police have not registered any crime based on the complaint made by the petitioner since the matter is civil in nature. 4. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
