ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S.VISHWAJITH SHETTY)
1. Accused in Crime No.64/2025 registered by Teradal Police Station, Bagalkot, for the offences punishable under Sections 109, 115(2), 352 of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.64/2025 was registered by Teradal Police Station, Bagalkot, for the aforesaid offences against the petitioner herein based on the first information dated 05.07.2025 received from injured Chetan Ashok Telagade. During the course of investigation, petitioner was arrested on 05.07.2025 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5148/2025 was rejected on 25.07.2025. Therefore, petitioner is before this Court.
4. Perusal of the first information submitted in the present case would go to show that the pigs which were reared by the petitioner were making noise and causing nuisance near the

house of the victim, and therefore, the victim had thrown stones at the pigs belonging to the petitioner to chase them away. It is in this background, on 04.07.2025 at about 19.30 hours, when the victim was talking to his friends, petitioner who went there, allegedly abused the victim by using filthy language, and thereafter, assaulted him with a knife which he had carried with him. In the said incident, victim had suffered two stab injuries which are said to be grievous in nature. The wound certificate of the victim would go to show that he was admitted to hospital on 04.07.2025 and discharged on 07.07.2025. His condition is now said to be stable. Investigation of the case is completed and charge sheet has been filed. Undisputedly, petitioner has no other criminal antecedents. Under the circumstances, I am of the opinion that petitioner’s prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following
order:
5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.64/2025 registered by Teradal Police Station, Bagalkot, for the offences punishable under

Sections 109, 115(2), 352 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
