PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Petitioner/Accused No.27 for granting of pre-arrest bail in connection with Crime No.97 of 2024 of Tadipathri Town Police Station, Ananthapuramu District, registered for the alleged offences punishable under Sections 147, 148, 188, 332 and 427 read with 149 of the Indian Penal Code, 1860 and Section 3 and 4 of Prevention of Damages of Public Property Act, 1984. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 2 3. As seen from the record, the petitioner/Accused No.27 is the present MLA of Tadiparthi. The allegation against him is that his followers went to the house of the former MLA belonging to the opposite party in the village and hurled stones. There is no reference about the petitioner being present at the scene of the alleged offence. Altogether, 209 persons have been arrayed as accused in this case. The learned Single Judge of this Court granted pre- arrest bail to Accused Nos.154 and 188 on 29.08.2024. So far, twenty-nine witnesses have been examined. This Court, in Crl.P.No.7883 of 2025 dated 06.08.2025, also enlarged Accused No.28, who is the former MLA, on pre- arrest bail. 4. Considering the facts and circumstances of the case, gravity and nature of the allegations leveled against the Petitioner/Accused No.27, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.27. 5. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.27 he shall be enlarged on bail subject to he executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.27 shall make himself available for investigation as and when required; iii.
