Heard Mr.P. Bordoloi, the learned counsel appearing for the petitioner as well as Mr. D P Goswami, the learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre- arrest bail in respect of Manja PS Case No. 21/2024 (corresponding to GR Case No.
Page No.# 2/2 178/2024).
3. On 07.08.2024, at about 11.30 AM, the truck bearing Registration No. AS-09DC/2733 was stopped by some people. They demanded Rs. 1 lakh from the truck driver. Ultimately, the informant being the owner of the truck had to pay a total amount of ₹70,000/- to two persons by Google Pay. Saret Hanse was paid ₹16,000/- and Phillipson Tiso was paid ₹54,000/-. Thereafter, the truck was allowed to go.
4. The CD reveals that at the time of occurrence the present petitioner was present and he also demanded money from the truck driver.
5. The learned counsel for the petitioner submits that his 9 year old son is ailing and he has to look after his 75 year old father.
6. The case depicts a clear story of dacoity on the road.
7. The provisions of law as laid down in Section 482 of the BNSS, 2023 are not meant to protect people like the petitioner. Therefore, his bail application is found to be devoid of merit and as such, the Anticipatory Bail Application filed by the petitioner Shri Mirlong Bey is dismissed and disposed of. The CD shall be returned.
