:: ORDER ::
Heard Sri Ganta Ediga Rakesh Goud, learned counsel for the petitioner and Sri Hari Babu Maguluri, learned Standing counsel for the respondents. 2. The above contempt case is filed complaining about the violation of the order dated 21.11.2024 in W.P.No.25403 of 2024. 3.
The petitioner filed the aforementioned writ petition to declare the action of respondents therein in not allowing the petitioner to discharge his duties as Village Organisation Assistant (VOA) in Bhavitha Village Women Mutually Aided Cooperative Thrift Society Ltd. @ Bhavitha Grama Sangham, Kalugotla village, as illegal and arbitrary. 4. The writ petition was disposed of directing respondents 3 to 6 therein not to interfere with the petitioner’s discharging his duties as Village Organisation Assistant (VOA) in Bhavitha Village Women Mutually Aided
Cooperative Thrift Society Ltd. @ Bhavitha Grama Sangham, Kalugotla village. 5. In the affidavit filed in support of the contempt case, it was specifically pleaded that the respondents have violated the order dated 25403 of 2024. 6. Respondent No.1 filed counter by annexing resolution dated
05.10.2024. A perusal of the resolution discloses that the petitioner was removed as VOA and a new incumbent was elected by the members of the aforementioned society. However, the said fact was not pleaded in the writ affidavit. 7. No rejoinder was filed by the petitioner disputing the same. 8. Given the resolution, dated 05.10.2024, since the petitioner was removed as Village Orginasation Assistant (VOA) of Bhavitha Village Women Mutually Aided Cooperative Thrift Society Ltd. @ Bhavitha Grama Sangham, Kalugotla village, the contention of the petitioner that the order, dated 21.11.2024 is violated, has no merit.
