GP FOR WOMEN DEV CHILD WELFARE(AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus to give direction to Respondents- 2 to 6 for not registering a criminal case and for not arresting the accused who have Honey trapped the petitioners son and husband respectively and demanding huge ransom by lodging a false case and defaming petitioners and their family and minor child through social media by the unofficial respondents which is illegal, arbitrary and unconstitutional and violation of article 14, 16, 21 and 300A of the constitution of India.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint of Respondent No.7 herein, a case in Crime No.7 of 2023 on the file of Disha Police Station, Vijayawada against the son of Petitioner No.1, who is the husband of Petitioner No.2. It is further submitted that the investigation in the said crime is completed and charge sheet is also filed. Learned Assistant Government Pleader would further submit that the Police have examined the contents of the complaint given by the Petitioners which would show only cognizable offences. As such, the Police made a entry in the register for non-cognizable offences and advised the petitioners to approach the Court. It is further submitted that, during the course of investigation in Crime No.7 of 2023, the Investigating Officer collected CDR, voice recordings and other material which would show the intimacy between the victim and the son of Petitioner No.1, apart from the confessional statement of the son of Petitioner No.1. 3 3. Sri C.Harshavardhan Rao, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 4. In that view, the Writ Petition is disposed of. However, the Petitioners are at liberty to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
