1. By the present writ petition, the petitioner who is working as Lecturer (LB) posted at Govt. Higher Secondary School, Lakhauli, Arang, District Raipur, preferred the present writ petition seeking a direction towards the respondent authority to consider the initial date of appointment of the petitioner i.e. 03.09.1998 for giving the benefit of old pension scheme.

Learned counsel for the petitioner submit that the petitioner has submitted a representation before the Secretary/respondent authorities on 25.04.2023 and the same is pending, it has not been decided till date. Learned counsel for the petitioner seeking a limited direction to the respondents to consider and decide the representation pending before the respondent authorities.

Learned counsel for the respondents/ State submits that looking to the limited prayer of the petitioner, the writ petition can be
disposed of with a direction to the Secretary to consider the representation within a stipulated period.
4. I have heard learned counsel for the parties and perused the documents.
5. Looking to the fact that the representation of the petitioner is pending since 2023, the concerned authority/ respondent No. 2 is
directed to consider and decide the representation of the
3 / 3 petitioner in accordance with law within a period of 50 days from the date of receipt of a copy of this order.
