The present application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to issue a direction to the Chief Judicial Magistrate, Mainpuri to decide the Sessions Trial No. 830 of 2008 arising out of Case Crime No. 84 of 2008, under Sections 354, 304/34 of I.P.C., Police Station Onchha, District Mainpuri within stipulated period. Learned counsel for the applicant fairly admits that the matter of the other co-accused persons has been decided by the Sessions Judge in the year of 2008, against which Appeal under Section 372 of Cr.P.C. is pending before this Court and the original file is summoned by this Court. The matter of other co-accused is pending for committal till today. As per report of the learned District Judge, the original file is not traced out. Both the parties are directed to appear before the court concerned for re-construction of the file with relevant documents within one month from today.
