ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioners/Accused Nos.3 & 5 for granting of pre-arrest bail in connection with Crime No.99 of 2025 of Renigunta Police Station, Tirupathi District, registered for the alleged offences punishable under Sections 109(1), 118(1), 116(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) Heard the learned Counsel for the Petitioners and the learned Assistant
2. Public Prosecutor. Petitioner No.2/Accused No.5 is a female aged about 59 years. The allegations levelled against her is that she accompanied Accused No.3 and picked up a quarrel with de-facto complainant. Whereas the allegation against Petitioner No. 1/Accused No.3 is that he beat the de-facto complainant with stick on her head and caused four injuries. The injuries are grievous in nature.
3. as per the wound certificate. This Court vide
order dated 09.10.2025 in CrI.P.No.10104 of 2025
4. granted pre-arrest bail to Accused Nos.1, 2 & 4 on several various grounds. Of course, there was delay of nearly twenty days in lodging the report by the de-facto complainant with the police. The reason assigned for the delay is she was undergoing treatment in the hospital. There are several disputes in between the parties. The de-facto complainant is aged about 69 years. Considering the specific overt acts attributed against the Petitioner
5. No. 1/Accused No.3 and the nature and gravity of the allegations levelled
3 against him, this Court is not inclined to grant pre-arrest bail to Petitioner No. 1/Accused No.3. Hence, the petition against Petitioner No. 1/Accused No.3 is dismissed.
6. For the reasons assigned above and in view of the nature and gravity of the allegations levelled against Petitioner No.2/Accused No.5 and her alleged role played in this case, this Court is inclined to grant pre-arrest bail to Petitioner No.2/Accused No.5.
7. In the result, the Criminal Petition is allowed so far as Petitioner No.2/Accused No.5 is concerned with the following conditions: In the event of the arrest, the Petitioner No.2/Accused No.5 shall be enlarged on bail subject to she executing a personal bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only), each with two sureties for the like sum each to the satisfaction I. of the arresting police officials. The Petitioner No.2/Accused No.5 shall cooperate with the Investigation Officer and shall make herself available for II. investigation as and when required. The Petitioner No.2/Accused No.5 shall not cause any threat, inducement or promise to the prosecution witnesses. The Petitioner No.2/Accused No.5 shall not commit or indulge in similar offences in future. III. iv.
, 4 The Petitioner No.2/Accused No.5 shall not leave the State of A.P., limits without the express permission from the Station House Officer concerned. V.
