1. The present petition has been filed purportedly in public interest for a direction to respondent no. 4 i.e. District Magistrate, Ghaziabad to take appropriate action on basis of applications of the petitioners dated 31.12.2024 and 16.05.2024 sent to him by registered post.
2. Learned counsel for the petitioners submits that the petitioners are social workers. However, no detail of any social work done by the petitioners has been given in the writ petition.
3. The case of the petitioners is that Plot No. 480/2M has vested in the State in view of Section 167(2) of the U.P. Zamindari Abolition and Land Reforms Act, 1950 and therefore, action should be taken against persons, who are allegedly in possession of the said land.
4. We find that some complaint was lodged on IGRS Portal and in response to the same, the Joint Magistrate/Sub Divisional Magistrate, Modinagar has submitted a report to the Deputy Registrar, Modinagar stating that entire Khasra No. 480 is having dense abadi. The persons, whose abadi are in existence, are not party to the instant proceedings.
5. In such circumstances, we are not inclined to issue any direction
at the behest of the petitioners in the present public interest litigation. We leave it open to the petitioners to avail such other remedy as may be advised.
6. The petition stands disposed of accordingly.
7. The order has been passed in presence of Sri Manu Saxena,
