GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Nos.2 and 3 in failing to conduct the investigation by arresting the named accused in Crime No.32 of 2021, dt.14.01.2021 and threatening to withdraw the complaint at the instance of the named accused as illegal, arbitrary and contrary to the provisions of Cr.P.C. and consequently direct the respondents to forthwith take up the 2 investigation by arresting the named accused in the above mentioned crime pending on the file of the 3rd respondent” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that a direction may be given to the respondent/police to conclude the investigation in Crime No.32 of 2021 and file a final report. 4. Learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 5. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed to conclude the investigation in the above crime and file a report in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order, if not filed charge sheet by this date. There shall be no order as to costs.
