WPMS 1121/2025
Hon’ble Manoj Kumar Tiwari, J.
Mr. Ankur Sharma, Advocate, for the petitioner.
(2) Petitioner is plaintiff in OS No. 75 of 2025. She is aggrieved by issuance of notice on her temporary injunction application by the trial court. Learned Counsel for the petitioner submits that trial court ought to have passed ex parte ad interim injunction in favour of the petitioner, in view of the urgency in the matter.
(3) This Court does not find any infirmity in the order impugned in the writ petition. The course adopted by the trial court is as per the provisions of Civil Procedure Code. Writ petition, however, is
disposed of with a request to the trial court to consider petitioner’s temporary injunction application on the next date fixed in the matter, provided all the respondents are served.
