The applicants have preferred first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita for grant of regular bail as they have been arrested in connection with Crime No.256/2024 registered at Police Station Kurud, District Dhamtari (C.G.) for the offence punishable under Sections 120-B, 302, 201, 34 of IPC. 2 2. The prosecution story in brief, it is alleged that the accused persons including present applicant hatched conspiracy for committing murder of deceased Firanta Patel and in furtherance of that conspirary, the accused persons committed murder of Firanta Patel by strangulation. 3. Learned counsel for the applicant submits that applicants have neither hatched any conspiracy, nor committed murder of deceased Firanta Patel, prosecution witnesses have been examined before the trial Court and have not supported the case of the prosecution and they turned hostile, prosecution has cited 36 witnesses therefore, the trial will take more time, hence he prays for release on bail to the applicants. 4. Learned counsel for the State opposes the submission made by learned counsel for the applicants and submits that offence committed by the applicants is grievous in nature. Hence, they are not entitled for grant of bail. 5. Heard learned counsel for both the parties. 6. Looking to the facts and circumstances of the case and looking to the gravity of the crime, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, the bail application of the applicants Harish Kumar Sahu and Mithlesh Dewangan filed under Section 483 of BNSS involved in Crime No. 256/2024 registered at Police Station Kurud, District Dhamtari (C.G.) for the offence punishable under Sections 120-B, 302, 201, 34 of IPC., is rejected.
