GP FOR REVENUE The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondent Nos. 3 and 4 herein in interfering with the peaceful possession and enjoyment of the Petitioner herein and insisting her to stop the construction of house in the site an extent of Ac.0.03 cents covered by Plot No.11-A in Sy.No.800/2 of Madakalavaripalle Village Lands, Badvel Municipal Limits, Kadapa 2 District at the - behest of 5th Respondent herein is illegal, arbitrary and violation of Articles 19 and 21 of the Constitution of India and without jurisdiction and consequently direct the Respondent Nos. 3 and 4 not to interfere with the peaceful possession and enjoyment of the land of the Petitioner and construction of the house in the land an extent of Ac.0.03 cents covered by Plot No.11-A in Sy.No.800/2 of Madakalavaripalle Village Lands, Badvel Municipal Limits, Kadapa District.” 2. Sri G.Ramesh Babu, learned counsel for the Petitioner would submit that, let there be a direction to the Police not to interfere with the peaceful possession and enjoyment of the land of the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by the husband of the Petitioner, a case in Crime No.316 of 2021 for the offences under Sections 341, 323 and 506 read with 34 IPC has been registered against the Accused and the Police after detailed investigation filed charge sheet before the Court of Additional Junior Civil Judge, Badvel and C.C number is awaited. It is further submitted that the Police never called the Petitioner and never interfered with the civil dispute. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil dispute pertaining to the subject land admeasuring Ac.0.03 cents covered by Plot No.11(A) in Sy.No.800/2 of Madakalavaripalle Village, Badvel Municipal Limits, Kadapa District. There shall be no order as to costs.
