The Court made the following order:
Questioning the action of respondents in not restoring the old age/widow/single woman pension, despite the same having been sanctioned to the petitioner long ago under the YSR Pension Kanuka Scheme, vide Pension ID No. 106507474, the present Writ Petition has been filed. 2.
Heard Sri B.V.Anjaneyulu, learned counsel for the petitioner, Ms Chandrika, learned Assistant Government Pleader for Panchayat Raj Department appearing for respondent Nos.1 to 3, Sri Haribabu Moguluri, learned standing counsel for DRDA appearing for respondent No.4 and Sri Y.Koteswararao learned standing counsel for Gram Panchayat and Mandal Praja Parishads appearing for respondent Nos.5 & 6. 3. Learned counsel for the petitioner, in elaboration to what has been stated in the affidavit, contended that after the demise of the petitioner’s husband, she became entitled to receive the old age/widow/single woman pension. Respondent No.4 issued pension book and paid the monthly pension regularly up to June, 2022. He further submitted that without issuing any notice, the pension was abruptly stopped from July, 2022. The petitioner submitted a representation dated 28.04.2025 under PGRS Programme, which was forwarded to respondent No.5 for redressal of her grievance. However, no action has been taken on the said representation and her pension has not been restored. Hence, prayed to pass appropriate orders protecting the interest of the petitioner. 4
4. On the other hand, learned standing counsel for Gram Panchayat and Mandal Praja Parishads, submitted that the petitioner is eligible for pension and the authorities are ready and willing to pay the same as per the scheme. 5. Perused the record and considered the submissions made by learned counsel for the parties. 6. It is not in dispute that the petitioner had been receiving pension under YSR Pension Kanuka up to June, 2022. The grievance of the petitioner is that without any justifiable reason, her pension has been stopped abruptly. The reasons assigned for discontinuation of pension is that the name of the petitioner’s husband appears in the ration card. 7. Taking the submissions of both the learned counsel into consideration, as the respondent authorities have expressed their intention to resume payment of pension to the petitioner, this Court is inclined to dispose of the Writ Petition with the following direction.
The respondent authorities concerned are directed to pay the petitioner her monthly pension, along with the arrears, in accordance with the provisions of the Pension scheme. There shall be no order as to costs. As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed. ___________________________ JUSTICE RAVI CHEEMALAPATI 04.11.2025 MP
