By this application, the Petitioner seeks an early disposal of the present writ petition in view of the averments made in the application. 2. Considering the grounds urged in the application, the same is allowed. Accordingly, the writ petition is taken up for hearing today. W.P.(C) 2428/2025 3. Ms. Sriparna Chatterjee, counsel for the Petitioner, submits that the Respondents are presently reconsidering the Petitioner’s Annual Confidential Report [“ACR”] for the Financial Year 2022-23. She submits that she is hopeful that, in the event the ACR is upgraded, the Petitioner’s case for promotion to the post of Chief Medical Officer with effect from 20th This is a digitally signed order. She further submits, on instructions, that with a view to bringing quietus to the long- standing disputes between the parties, the Petitioner is willing to withdraw all pending litigations against the Respondent, including the present writ petition, subject to the aforesaid relief being granted. 4. In this regard, an undertaking has been furnished by the Petitioner in paragraph 7 of CM APPL. 43098/2026, which reads as under: “That the Petitioner further undertakes that upon such promotion being granted, she shall neither pursue any pending claims nor initiate any fresh proceedings arising out of the disputes forming the subject matter of the present litigation and the connected proceedings. Therefore, the present application is being filed for advancing the date of hearing in the matter so that the Writ Petition can be disposed of at an early date. The urgency behind the present application is that the petitioner is scheduled to retire in October 2026.” 5. Mr. Anupam Varma, counsel for the Respondent, on instructions, confirms that the Petitioner’s ACR for the Financial Year 2022-23 is presently under reconsideration pursuant to her representation. He further submits that, in the event the Petitioner’s ACR is upgraded and she meets the prescribed benchmark, her case for promotion to the post of Chief Medical Officer with effect from 20th May, 2024 shall be considered, subject to her fulfilling the applicable eligibility conditions. 6. In view of the above, the present petition is disposed of with the following directions: (i) The Petitioner’s representation against the ACR for the Financial Year 2022-23 shall be considered and decided within a period of three weeks from today. (ii) In the event the Petitioner meets the prescribed benchmark and This is a digitally signed order. In the event the Petitioner’s grievance is not redressed, it shall be open to her to avail of such remedies as may be available in law. 8. It is clarified that this Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are kept open. 9.
