Following relief has been claimed in this writ petition - i. That the Hon’ble Court may kindly be pleased to direct the respondent authority to give the compassionate appointment to the petitioner. 2 ii. That the Hon’ble Court may kindly be pleased to call the service book of the deceased Sukhram Mahilang for perusing the member of the nominee. iii. Any other relief, which may be deemed, fit by this Hon’ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 3. Learned counsel for the petitioner submits that the father of the petitioner namely –Sukhram Mahilang was working with the respondents as Sub-Registrar and died in harness on 21/04/2016. The petitioner is the son of the second wife of the employee. He submits that he made an application dated 06/04/2019 for grant of compassionate appointment before the respondent authorities but till date it has not been granted. He submits that initially the son from the first wife of the deceased employee made an objection, however, subsequently his statement was recorded by respondent No.3 in which he has given no objection for consideration of the case of the petitioner for compassionate appointment. He submits that the petitioner may be permitted to make a fresh application for compassionate appointment before the concerned respondent authority who may be directed to decide the same in accordance with law. 4. Learned State counsel submits that initially the dispute was between the two brothers born out of the first and second wife of the deceased employee, however, the fresh application has been made by the petitioner for considering his case for grant of compassionate appointment, the same would be decided by the competent authority in accordance with law. 5. Heard learned counsel for the parties and perused the records. 6. Be that as it may, this writ petition at this stage is disposed off permitting the petitioner to make fresh application for compassionate appointment to respondents 2 and 3 within a period of 30 days from the date of receipt of copy of this order. On such application is made, it is expected that respondents 2 and 3 shall take decision on it in accordance with law within a further period of 90 days from the date of its receipt after hearing the stakeholder if any.
