[2025:RJ-JP:16038-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D. B. Special Appeal (Writ) No. 297/2025 In S. B. Civil Writ Petition No. 17716/2024 Rajeev Kumar Singh S/o Shri Priya Mangal Singh, Aged About 49 Years, Resident Of 454, Keshav Nagar, Vaishali Nagar, Ajmer. ----Appellant Versus 1. Chairman (Discoms), Vidhut Bhawan, Jyoti Nagar, Jaipur. 2. Managing Director, Ajmer Vidhut Vitran Nigam Limited, Panchsheel Nagar, Makkarwali Road, Ajmer. 3. Ajmer Vidhut Vitran Nigam Limited, Through Its Secretary, (Administration), Panchsheel Nagar, Makkarwali Road, Ajmer. ----Respondents For Appellant : Dr. Saugath Roy Advocate. HON'BLE THE CHIEF JUSTICE MR. MANINDRA MOHAN SHRIVASTAVA HON'BLE MR. JUSTICE ANAND SHARMA Judgment 15/04/2025 1. Heard. 2. Though number of grounds have been urged to assail the correctness and validity of order of penalty, we find that the learned Single Judge has refused to entertain the writ petition and dismissed the same as barred by delay and laches. 3. Though learned counsel for the appellant would strenuously urge before us that the order was not served and the appellant came to know when he contacted in the office 15 years after the appeal was preferred, there are no specific averments on affidavit [2025:RJ-JP:16038-DB] (2 of 2) [SAW-297/2025] that the order passed in appeal was never served on the appellant. Vague averments in the writ petition do not make out a case of such nature, what has been argued before us. It is improbable that an employee would not know about passing an order in appeal 15 years before while suffering imposition of penalty of withholding increments. 4. No case for interference by this Court is made out. 5. Appeal is, accordingly, dismissed. (ANAND SHARMA),J (MANINDRA MOHAN SHRIVASTAVA),CJ MANOJ NARWANI-DIVYA /20
