1. This is an ofÏce reference.
2. This Court, vide order dated 02.08.2024, passed in MCRC No. 5463 of 2024, while allowing the bail to the applicant, namely, Bharat, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this
order, if there was no legal impediment.
3. The learned Judicial Magistrate First Class, Pithoura, District- Mahasamund (C.G.) vide his request letter dated 06.01.2025 has KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 requested for grant of six months time for concluding the trial.
4. It transpires from perusal of the PUD, that in this case, accused Bharat Bhau is absent at the stage of framing of charges and a warrant has been issued against him. He has been declared a fugitive and further proceedings have been initiated. Meanwhile, charges were framed against another accused, Aslam Hasan Sheikh, on 20.11.2024 and the case has been posted for prosecution evidence. During the recording of evidence, accused Aslam Hasan Sheikh remained absent and a warrant has been issued against him for his presence. In view of the absence of the accused and the facts and circumstances of the case, it is not possible to conclude the trial within the stipulated time, hence, he prays for grant of further six months time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of six months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
